Class Action Settlement for Day Scholars

The Day Scholar Compensation Payment Claims Process is now OPEN.  The deadline to apply is October 4, 2023.

A settlement in the Day Scholars Class Action has been approved by the Federal Court, and eligible claimants can apply for the Day Scholar Compensation Payment.

Day Scholars, also known as Survivor Class Members, are people who attended Indian Residential Schools (IRS) as students during the day only but did not sleep there overnight.  The Descendant Class Members are the children of Day Scholars.

The settlement agreement provides that every eligible Day Scholar Survivor will be able to make a claim for a Day Scholars Compensation payment of $10,000.  For eligible Day Scholars who were alive as of May 30, 2005, but have died since, a claim can be made on behalf of their estate by an estate executor, administrator, trustee or liquidator, or if none is appointed, their highest priority heir. 

Canada will also pay $50 million to establish the Day Scholars Revitalization Fund for the benefit of the Day Scholar Survivors and their Descendants.
